Abhan: Bringing the Masses Without Obeying the Covid Protocol Bapaslon Will be Sanctioned

Jakarta, Election Supervisory Body - Head of Bawaslu Abhan stated that regional heads of candidates (bapaslon) who brought the masses to the regional election stage process without heeding the Covid-19 health protocol would be given strict sanctions. According to him, the health protocol violators will later be handed over to the authorities for law enforcement.

This affirmation was conveyed by Abhan in a joint meeting related to Discipline and Law Enforcement of Health Protocols in Pilkada. The meeting was held with the KPU, the Ministry of Home Affairs (Kemendagri), the Coordinating Ministry for Political, Legal and Security Affairs of the Republic of Indonesia (Polhukam) and the National Disaster Management Agency (BNPB), in Jakarta, Wednesday (9/9/2020).

"When someone enters crowd areas, they must first get permission from the police. Then later the notification receipt letter will be received by the police, and Bawaslu will then coordinate, "said Abhan.

He explained that violations of health protocols that brought crowds to mass registration of candidates yesterday were not explicitly regulated in the General Election Commission Regulation (PKPU). Abhan assessed that the right rules imposed on offenders refer to other provisions related to health protocols.

"As for the application of other laws related to health protocols by offenders, they can refer to Law No. 4 of 1984 concerning outbreaks of infectious diseases and Law 6 of 2018 concerning health carantina, and Presidential Instruction No. 6 of 2020 on improving discipline and law enforcement. health protocol, "he explained.

In addition, Abhan said that in terms of imposing sanctions by violators of health protocols there are other mechanisms. He explained that the imposition of sanctions could be carried out on the basis of Presidential Instruction Number 6 of 2020 concerning Increasing Discipline and Law Enforcement of Health Protocols in the Prevention and Control of Covid - 19.

"There is in article 218 where the article states whoever the people come and gather deliberately not to leave immediately after being ordered three times by or on behalf of the competent authority, is threatened for participating in a grouping with a maximum imprisonment of four months and two weeks," he explained.
