Registered with the KPU, 141 Bapaslon Allegedly Violated Health Protocol Regulations

Jakarta, Election Supervisory Body - Bawaslu member Fritz Edward Siregar said that out of 315 prospective pairs of candidates (bapaslon) who had registered, as many as 141 Bapaslon were suspected of violating health protocol rules. The alleged violation is related to the number of people who came to the local KPU office when they wanted to register as participants in the 2020 simultaneous regional elections.

"The 141 Bapaslon are suspected of violating PKPU rules (PKU Regulations) which explicitly prohibit convoys and processions in the midst of the Covid-19 pandemic," said Fritz in Jakarta, Saturday (5/9/2020) when he was a resource person for a national television station.

On this matter, Fritz emphasized, Bawaslu will do two things. First, in the form of suggestions for improvement (warning). Second, report chameleons who violate health protocols to other authorized parties such as the police. According to him, it is the duty of Bawaslu to carry out supervisory and law enforcement functions. In addition, he believes it is an obligation for everyone to prevent the spread of covid-19 from occurring.

Fritz also revealed that the KPU had carried out socialization long beforehand to political parties (parpol) to come only bringing Bapaslon, LO (Liaison Officer / liaison), and representatives of political party administrators. This is for him as part of implementing health protocols.
Regarding sanctions, continued Fritz, when referring to the Election Law (UU) and PKPU, what Bawaslu is doing is suggesting improvements and also giving allegations of administrative violations to the chaplain or KPU that is suspected of violating it.

"Against these violations, Bawaslu not only provides suggestions and corrections, but is also considered violating the mechanisms and procedures that have been regulated in PKPU," he said.

He added, in addition to the Election Law, there are other laws that need to be considered, for example Law Number 4 of 1984 concerning Contagious Disease Outbreaks and Law Number 6 of 2018 concerning Health Quarantine.
Fritz emphasized that if the Bawaslu study found violations related to the two laws, then Bawaslu would recommend it to other parties such as the police to follow up further. For him this is in accordance with Law Number 6 of 2020 concerning Stipulation of Government Regulations in Lieu of Law Number 2 of 2020 concerning the Third Amendment to Law Number 1 of 2015.

"The procession and mobilization of the masses in my opinion have the potential or can be suspected of violating Article 14 of Law 4/1984 and Article 93 of Law 6/2018 or prohibitions from local regulations. For this reason, the Provincial / City District Bawaslu forward findings or reports that are not authority to the competent authorities in accordance with Article 28 (1) e and Article 33 e of Law 6/2020, "explained Fritz.

The Coordinator of the Legal, Public Relations Division and Information Data Bawaslu hopes that there will be no new clusters for the spread of Covid-19. He believes that the implementation of regional elections during the Covid-19 pandemic is not just the task of the KPU and Bawaslu, but is also the duty of the nation's components to make the democratic party successful along with eradicating Covid-19. So, he suggested, all parties should not only talk about electoral techniques, but also adhere to health protocols.

"Complying with health protocols is our common commitment. We need to firmly apply each party to the health protocol. The firmness of the Police, Satpol PP, Satgas, Lemda, and all parties to implement health protocols, "he added.
