Jakarta, Election Supervisory Board – The memorandum of understanding about the neutrality of Civil State Apparatus (ASN) in organizing the election for local leaders 2015 agreed by the Elections Supervisory Board, Ministry of Efficient Utilization of State Apparatus – Bureaucracy Reformation, the State Personnel Board, Commission of State Civil Apparatus, and the Ministry of Domestic Affairs at the beginning of October was immediately followed up with an investigation of a number of alleged violations committed by the Civil State Apparatus.
Chairman of Election Supervisory Board, Nasrullah, said that the Election Supervisory Board had founded indications of violations committed by the Civil State Apparatus to support the incumbent's candidacy in the elections for local leaders 2015. "There are various modes. The simplest mode is as follows: the Election Supervisory Board finds the indirect campaign by incumbent in a newspaper by displaying programs of the local government accompanied with the photograph of the incumbent. Once traced, the one who put an ad in the newspaper is an official of the local government who is a Civil State Apparatus, even his/her photograph is also displayed, "said Nasrullah during a coordination meeting with State Personnel Board and Commission of State Civil Apparatus in the Meeting Room, 2nd Floor, Election Supervisory Board Building, Friday (16/10).
Not only in the newspaper, said Nasrullah, the incumbent was also putting up banners and billboards. "The incumbent is already utilizing the state facility. The Budget used is the state money, either the local budget and the state budget, it can be categorized as corruption. Meanwhile, the Civil State Apparatus involved should receive decisive actions by the Commission of State Civil Apparatus or the State Personnel Board," he said.
Furthermore Nasrullah said that Election Supervisory Board would soon go to the field to investigate alleged violations that brought destruction to the democratic system in Indonesia. "The Election Supervisory Board has also found that in the local level there is a massive movement performed by the Civil State Apparatus to support one of the candidates. Therefore, the Election Supervisory Board starting from Monday (19/10) will keep going to the field as a preventive measure of the occurrence of the violation," he said.
Meanwhile the Commissioner of the Commission of State Civil Apparatus, Waluyo, said that the agency was also ready along with Election Supervisory Board to participate in the action to the field. "We will also go to the field together with the Election Supervisory Board to investigate alleged violations that have been found by Election Supervisory Board. If there is a violation committed by a Civil State Apparatus, will we act firmly and we will report also to the State Personnel Board and the State Ministry of Efficient Utilization of State Apparatus – Bureaucracy Reformation, "said Waluyo.
Suhari, a Personnel Auditor of the State Personnel Board, said the similar statement. The State Personnel Board would also hold an investigation against such violation. He explained that until now there had been no reports to the State Personnel Board regarding any Civil State Apparatus who conduct violations in the election for local leaders. However, upon the report of the Election Supervisory Body, the agency would also make an immediate follow up. "For the local level we will work closely with the Office of the regional State Personnel Board. A Civil State Apparatus who conduct violations will be penalized, from mild to severe sanctions. There is a Civil State Apparatus who cannot be promoted even dismissed, "he concluded.
Any violence committed by the State Civil Apparatus or the incumbent would be investigated uder the regulations of Article 71 and Article 189 of Law No. 8 of 2015, Law No. 5 of 2014, Law No. 31 of 1999 jo Law No. 20 of 2001, and Article 4 of Government Regulation No. 53 of 2010.
